  • Manage your digital legacy with secure encryption technology

3. Account Registration and Security

3.1 Account Requirements

  • You must be at least 18 years old to use this Service
  • You must provide accurate and complete registration information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account

3.2 Password Security

  • Your password is used to derive encryption keys for your content
  • Critical: If you lose your password, we cannot recover your encrypted content
  • You are solely responsible for backing up your login credentials securely
  • We recommend using a password manager and storing recovery information

3.3 Account Verification

  • We may require email verification to activate your account
  • We reserve the right to suspend accounts pending identity verification
  • False information in your registration may result in account termination

4. Use of the Service

4.1 Permitted Uses

  • Managing recipient access and security settings
  • Configuring delivery triggers and conditions
  • Accessing your encrypted content through our secure portal

4.2 Prohibited Uses

You may not use the Service to:

  • Store or transmit illegal, harmful, threatening, or harassing content
  • Violate any applicable laws or regulations
  • Impersonate others or provide false identity information
  • Attempt to circumvent our security measures or encryption
  • Upload malware, viruses, or other malicious code
  • Interfere with the proper functioning of the Service

4.3 Content Responsibility

  • You are solely responsible for all content you create and store
  • You retain ownership of your content, but grant us necessary rights to provide the Service
  • You represent that you have all necessary rights to your uploaded content
  • We are not responsible for the content you choose to include in your legacy messages

5.3 Data Retention

  • Your encrypted content is retained indefinitely to fulfill our service promise
  • Account information is retained while you continue to access and use the platform
  • You can delete your account and associated data at any time while you have access
  • Warning: Account deletion permanently destroys your legacy content

6. Recipient Access and Delivery

  • You may designate recipients who will receive your legacy content
  • Recipients must verify their email addresses to receive content
  • You are responsible for providing accurate recipient contact information

6.2 Content Delivery

  • Content delivery is triggered based on the conditions you specify
  • We make reasonable efforts to deliver content with the following commitment:
    • Year-by-Year Delivery Guarantee: For content scheduled beyond one year, we guarantee delivery on a rolling annual basis. This means:
      • Content scheduled within the current year is guaranteed for delivery
      • For multi-year scheduling, we commit to each year as it arrives, dependent on service continuity
      • Example: Content scheduled for 2 years will have Year 1 guaranteed now, and Year 2 guaranteed when that year begins
    • This approach ensures transparency about long-term service sustainability while maintaining our commitment to deliver your legacy
  • Recipients receive secure, cryptographically signed access links with time-limited validity
  • Delivery may be delayed due to technical issues or recipient responsiveness

6.3 Recipient Responsibilities

  • Recipients are responsible for maintaining the confidentiality of access links
  • Recipients may only access content designated specifically for them
  • Recipients may not share, redistribute, or misuse the content they receive
  • Recipients can request new access links through the portal if their original links expire

7. Service Availability and Modifications

7.1 Service Availability

  • We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service
  • We may perform scheduled maintenance with advance notice when possible
  • We are not liable for service interruptions beyond our reasonable control

7.2 Service Modifications

  • We may modify, update, or discontinue features with reasonable notice
  • We will maintain backward compatibility for core encryption and access features
  • Significant changes that affect your rights will require your consent

7.3 Inactivity Monitoring and Legacy Activation

  • When you stop accessing your account, we monitor inactivity based on your configured settings
  • We send check-in reminders to help prevent unintended legacy activation
  • After your configured inactivity period plus grace period, your account triggers legacy delivery to recipients
  • You can modify inactivity settings at any time while you still have access to your account

8. Intellectual Property

8.1 Your Content

  • You retain all rights to the content you create and store
  • You grant us a limited license to store, process, and deliver your content as necessary
  • This license terminates when you delete your content or account

8.2 Our Intellectual Property

  • The EternalSelf platform, software, and associated materials are our property
  • You may not copy, modify, or reverse engineer our platform
  • Our trademarks and branding remain our exclusive property

9. Fees and Payment

9.1 Service Fees

  • Current pricing is available on our website and in your account dashboard
  • Fees are subject to change with 30 days advance notice
  • All fees are non-refundable except as required by law

9.2 Payment Terms

  • Payment is due in advance for subscription services
  • We accept major credit cards and other payment methods as available
  • Failed payments may result in service suspension after reasonable notice

9.3 Account Suspension

  • Non-payment may result in account suspension but not immediate deletion
  • Suspended accounts retain encrypted content for a reasonable grace period
  • You may reactivate suspended accounts by bringing payments current

10. Disclaimers and Limitations

  • The Service is provided "as is" without warranties of any kind
  • We do not guarantee the accuracy, completeness, or reliability of the Service
  • We cannot guarantee successful delivery of legacy content to recipients
  • Technical issues may prevent access to your encrypted content

  • Our liability is limited to the amount you paid for the Service in the past 12 months
  • We are not liable for indirect, incidental, or consequential damages
  • We are not responsible for content loss due to forgotten passwords or credentials
  • We are not liable for recipient actions or misuse of delivered content

  • We recommend maintaining secure backups of your login information

11. Indemnification

You agree to indemnify and hold EternalSelf harmless from any claims, damages, losses, or expenses arising from:

  • Your use of the Service or violation of these Terms

12. Termination
